About providing official interpretation of the Statement about the special fund of material encouragement of personnel of state budget facilities and organizations (reg. №177 as of September 20, 1995)

In connection with the requests related to wage rise for state budget organizations personnel, as well as with the purpose of avoiding misinterpretation of legislative norms in the sphere of stimulation of personnel of state budget organizations, I hereby order:

  1. To provide the official interpretation of the Statement about special fund of material stimulation of personnel of state budget organizations and facilities, endorsed by the Ministry of Finance of the Republic of Uzbekistan on September 8, 1995 (reg. № 177 as of September 20, 1995), according to the attachment.
  2. To submit the current order to the Ministry of Justice of the Republic of Uzbekistan for harmonization in the period of ten days after endorsement.
  3. To distribute the current order for implementation after harmonization with the Ministry of Justice of the Republic of Uzbekistan.

OFFICIAL INTERPRETATION

Of the Statement on the special fund on material stimulation of personnel of state budget facilities and organizations personnel (reg. № 177 as of September 20, 1995)

1. In line with the item 3.2 of the Statement on the special fund on material stimulation of personnel of state budget facilities and organizations, Statement on the special fund for material stimulation of personnel of state budget facilities and organizations, with the purpose of encouragement of self-starter and conscientious performance of discharge of their professional duties by highly-qualified workers of state budget facilities and organizations there are being established personal pay rises for high achievements in labor in the size of no more than 50 per cent of salary (basic wage rate). The indicated pay rises are not limited by maximal sizes at the state management organs financed from state budget means.

The aforementioned pay rises are established for managers by the higher authorities, and for the rest – by the manager of the facility or organization.

The pay rises at public authorities and state management bodies are established by the manager of the body. Material stimulation of the managers of public authorities and state management bodies are performed by the decision of the higher authority.

The rises are abolished or reduced in cases of worsening of work quality, belated execution of tasks, breaking of labor and production discipline.

2. In line with the article 180 of Labor Code of the Republic of Uzbekistan encouragement measures can be applied to worker for achievements in work. The types of encouragement, order of their application, provision of advantages and privileges are identified through blanket arrangements, regulations and statutes about discipline.

Salary, awards, additional payments foreseen by the wage system are not referred to encouragements.

Encouragement measures are not applied to worker within effective period of disciplinary penalty (article 183).

3. In line with the article 153 of Labor Code of the Republic of Uzbekistan the minimal level of labor remuneration terms for personnel of facilities and organizations financed from state budget, as well as state enterprises is established by legislation (including: Decree of the President of the Republic of Uzbekistan as of August 16, 1995 № УП-1213 «About increasing the sizes of pensions, allowances, stipends and salaries in state budget facilities and organizations of the republic”, Decree of the Cabinet of Ministers of the Republic of Uzbekistan as of April 12, 1996 № 147 «About introduction of scale of rates for remuneration of labor of personnel of public authorities and management bodies, judicial bodies and notarial offices”, and other normative acts).

The full list of disciplinary penalty measures is identified by the Article 181 of Labor Code of the Republic of Uzbekistan.

Taking into account the aforementioned, the cancellation or reduction of markups in cases of deterioration of quality of work, ill-timed execution of tasks, breaking labor and production discipline, foreseen in the item 3.2 of the Statement about the special fund of material stimulation of workers of state budget facilities and organizations is not the measure of disciplinary penalty. Abolition or reduction of the pay rise at deterioration of the work quality, untimely execution of tasks, breaking labor discipline is the right, but not obligation of manager or organization. That is why, in case of application of disciplinary penalty to staff member the manager can abolish or reduce this makeup, but this is not a obligation for the manager.
