I. GENERAL PROVISIONS

1. The current Provisions are developed in line with the Decree of the President of the Republic of Uzbekistan as of September,19 2007 #УП-3923 “About main directions of further deepening of reforms and realization of the State Program on Development of Healthcare” and Decree of the President of the Republic of Uzbekistan as of October, 2, 2007 # ПП-700 “About measures on perfection of work of healthcare facilities of the republic” and identifies tasks, functions, rights and responsibilities of the Department on licensing and control of quality of healthcare services provided by non-governmental facilities of the Ministry of Health of the Republic of Uzbekistan (further – Department on licensing and control).

2. Department of licensing and control is a structural unit of the central office of the Ministry of Health of the Republic of Uzbekistan.

3. Department of licensing and control in its activities is guided by the Constitution and Laws of the Republic of Uzbekistan, Resolutions of Chambers of Oliy Majlis (Parliament) of the Republic of Uzbekistan, Decrees, Resolutions and Directions of the President of Republic of Uzbekistan, Decrees and Orders of the Cabinet of Ministers of the Republic of Uzbekistan, the current Statement, as well as Orders and Instructions of the Ministry of Health of the Republic of Uzbekistan.

II. MAIN TASKS AND FUNCTIONS OF THE DEPARTMENT OF LICENSING AND CONTROL

4. The main tasks of the Department of licensing and control are:

Organization of work on licensing of medical activity;

Performing deep analysis of adequacy of applicants for the license to licensing requirements and conditions;

Performing control over compliance of the medical services provided by licensees to the allowed to use, in established by law order, prevention, diagnostic and treatment means;

Summarizes and analyses the information on following by licensees the licensing requirements and conditions, quality of medical services of the licensees, received during monitoring and based on the results of check-ups;

In case of revealing of violations submission to the management of the Ministry of Health of the Republic of Uzbekistan proposals on suspension, halting or abolition of duration of license in established order

5. In line with the assigned tasks the Department of licensing and control performs the following functions:

Performs expertise of documents submitted by seekers of license for execution of medical activities;

Forms expert groups, arranges primary, and if necessary, additional expertise of conditions for execution of medical activities by license seekers;

Within its jurisdiction presents to license seekers the required information, provides consultative and methodological assistance;

Completes the license forms, informs license seekers on decisions taken by the Ministry of Health of the Republic of Uzbekistan on the issues related to issuance of license, in the established order reissues licenses or issues their duplicates;

Keeps register and centralized data base, containing information on implementation of the licensing requirements and conditions, including those about quality of services provided;

Participates at check-ups being performed by the Ministry of Health in the established order on observance by the licensees the licensing requirements and conditions;

Delivers obligatory for implementation prescriptions in cases of ascertainment of facts of violations of licensing requirements and conditions, as well as of quality specifications for services provided by licensees;

In order established by law prepares the necessary documents for taking decision and reference to court with request about suspension, termination or abolition of license for performing medical activities;

Participates in development of draft normative-legal acts in the sphere of licensing of medical activities;

Summarizes and analyses information on quality of healthcare services being provided by the licensees, received during monitoring or as a results of check-ups;

Together with appropriate units of the Ministry of Health of Uzbekistan participates in development and implementation of diagnostic and treatment standards, clinical protocols and recommendations into medical practice.

6. Department of licensing and control performs continuous monitoring over observation of licensing requirements and conditions by the licensees through:

Inquiring population, including questionnaires;

Accepting and studying messages from citizens;

Getting information from hotlines established at the central office of the Ministry of Health of Uzbekistan and territorial health departments;

Collection, summarization and analysis of information, coming as outcomes of check-ups of work of licensees, performed by controlling institutions;

Acquaintance with the status and conditions of performance of licensed activity on spot, without interference to financial and economical activities (The paragraph is introduced in line with the Decree of Cabinet of Ministers of the Republic of Uzbekistan as of 26.11.2010 г. # 270)

III. RIGHTS AND RESPONSIBILITY OF

THE DEPARTMENT ON LICENSING AND CONTROL

7. For execution of the tasks and functions in the limits within its jurisdiction the Department of licensing and control has a right to:

Request and receive from the licensees during the check-ups the necessary documents and other information directly linked to the check-ups;

Make obligatory for execution directions about elimination of the revealed violations, establish timeframe required for elimination of such violations;

Request and receive from other controlling organs information about outcomes of check-ups they have performed on the activities of licensees in the part regarding the issues of quality of medical services they provide;

Put forward to the management of the Ministry of Health of the Republic of Uzbekistan proposals on improvement of work, related to licensing of medical activities, conducting control over observance of licensing requirements and conditions, as well as quality of medical services by the licensees.

8. Department of licensing and control is accountable for effective performance of tasks and functions incumbent, as well as for objectivity and complexity of the analytical documents submitted.

IV. ORGANIZATION OF WORK OF THE DEPARTMENT

OF LICENSING AND CONTROL

9. Department of licensing and control is staffed by high skilled specialists with higher medical, pharmaceutical and legal education.

Department of licensing and control subordinates directly to minister of health of the Republic of Uzbekistan.

10. Department of licensing and control is led by Head, who is appointed and dismissed by the minister of health of the Republic of Uzbekistan.

Head of Department of licensing and control has one Deputy. In absence of the Head of Department and Control his functions are performed by the Deputy.

11. Head of Department of Licensing and Control:

Performs general management, supervises the work of the Department of licensing and control;

Bears personal responsibility for effective performance of tasks put on the Department of licensing and control, objectivity and complexity of analytical materials and documents submitted;

Coordinates activity of units of the Department of licensing and control, distributes functional duties amongst personnel of units, defines the level of responsibility of each staff member for fulfillment of specific tasks;

Brings in to the Minister of Health of the Republic of Uzbekistan proposals on appointment and dismissal of Department staff members, as well as on encouragement of staff of the Department and calling to disciplinary account;

Develops and brings in to the management of the ministry proposals on improvement of work of the Department of Licensing and Control;

Regularly informs minister of health of the Republic of Uzbekistan about the work of the Department of Licensing and Control.

12. Department of Licensing and Control consists of two units:

Unit on licensing of medical activities;

Unit of quality control of medical services provided by non-governmental facilities, dealing with private practice. (Paragraph as revised in the Decree of the Cabinet of Ministers of the Republic of Uzbekistan as of 26.11.2010 г. # 270) (See the previous revision)

13. Personnel of the Department of licensing and control is appointed and dismissed by the minister of health of the Republic of Uzbekistan based on nomination from the Head of the Department of Licensing and Control.

Personnel of the Department of licensing and control perform its work in line with the spheres of action, endorsed by the minister of health.

14. At the territorial health care management organs the control over quality of medical services provided by licensees is performed by chief specialists on control of quality of medical services of the Ministry of Health of the Republic of Karakalpakstan, health care departments of regions and the city of Tashkent (further – chief specialists).

Chief specialists are appointed and dismissed by the minister of health of the Republic of Karakalpakstan, heads of regional health departments and of the city of Tashkent as agreed with the Department of Licensing and Control of the Ministry of Health of the Republic of Uzbekistan.

15. Certification of the staff of the Department of Licensing and Control, as well as chief specialists is performed in line with the procedure established by law.
