I. GENERAL PROVISIONS

1. The Control Inspection is created at the Ministry of Health of the Republic of Uzbekistan and directly reports to Minister of Health of the Republic of Uzbekistan.

The Control Inspection of the Ministry of Health has territorial subdivisions in the Republic of Karakalpakstan, in all regions and the city of Tashkent, which have vertical management system and directly report to Head of the Control Inspection.

2. The Control Inspection of Ministry of Health of the Republic of Uzbekistan is guided in its activities by the Constitution of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan “About Protection of Health of Citizens”, decrees and orders of the President of the Republic of Uzbekistan, Resolutions and Directions of the Cabinet of Ministers of the Republic of Uzbekistan, normative acts of the Ministry of Health of the Republic of Uzbekistan, as well as other legislative acts.

II. MAIN TASKS OF THE CONTROL INSPECTION

3. The main tasks of the Control Inspection are as follows:

- monitoring health care bodies, medical - preventive and sanitary facilities, regardless to pattern of ownership and financing sources on compliance with legislative acts and standard regulations on the issues of securing protection of population health;

- taking measures on suppression of corruption and abuse by management officials and staff of health care facilities;

- setting up control over procurement, realization and target use of drugs and medical goods at health facilities funded with involvement of budget means;

- introduction in due course proposals on bringing to responsibility the health care staff, breaking a law, to material, administrative and criminal liability.

III. FUNCTIONS OF THE CONTROL INSPECTION

4. In order to perform the assigned tasks the Control Inspection:

- performs control over and checks the work of public health management bodies, health facilities on performance of their duties, observance of constitutional rights of population for getting qualified health care and legislation on protection of citizens health;

- considers and studies complaints and claims related to illegitimate actions of health care workers, conducts an official inquiries and inspection on facts of violations of constitutional rights of citizens;

- performs control over observance of the established practice at procurement, realization and target use of drugs and medical goods, procured using state budget funds at pharmacies and medical institutions, including conducting unexpected audits;

- informs Minister of Health of the Republic of Uzbekistan about uncovered violations of legislation on protection of health of citizens, outcomes of official inquiries on complaints and claims of citizens;

- prepares drafts of orders, submits proposals on elimination of uncovered violations of legislation for consideration of the Collegium of the Ministry of Health of the Republic of Uzbekistan, on bringing to financial, administrative or other, as provided for in the legislation, responsibility the health care workers, who did not ensure adhering to requirements specified in the legislation on health protection;

- coordinates its work with the Main Auditing Department of the Ministry of Finance of the Republic of Uzbekistan for conducting joint audits of financial and economic activities in the health care management authorities and health care facilities.

IV. RIGHTS AND DUTIES OF THE CONTROL INSPECTIONS

5. The Control Inspection has a right to:

- send by order of Minister of Health of the Republic of Uzbekistan or in accordance with endorsed plan of work inspection groups to perform check-ups and audits on the issues of compliance with legislation on healthcare;

- check-up at healthcare management authorities and health care facilities of all levels documents related to their performance;

- freely enter, in compliance with the established order of access, to all premises of health care facilities during performance of tasks incumbent on it;

- perform control and audit on procurement and realization of drugs, healthcare products, as well as over implementation of terminal markups;

- get written pleadings from managers and other officials of healthcare management institutions and healthcare facilities on facts of breaking of legislative requirements;

- involve, in agreement with the management of the Ministry of Health, specialists of other structural subdivisions for participation at check-ups, as well as at preparation of materials of Collegium and Orders of the Ministry of Health.

6. The Control Inspection is obliged to:

- follow requirements of the Law of the Republic of Uzbekistan “About Protection of Health of Citizens”, other legislative and normative acts;

- strictly keep state secrets and secrecy order for the works being performed, confidentiality of check-ups and audits being conducted;

- ensure qualified, independent, grounded evaluation of activities of healthcare and pharmaceutical facilities being checked.

V. ORGANIZATION OF WORK OF THE CONTROL INSPECTION

7. Composition of the Control Inspection of the Ministry of Health of the Republic of Uzbekistan is established and staffed by highly skilled experts with higher juridical, medical, pharmaceutical and economical education.

8. The Control Inspection is led by the Head, appointed by the Minister of Health of the Republic of Uzbekistan.

9. The Control Inspection staff is appointed and dismissed by the Minister of Health of the Republic of Uzbekistan upon the recommendation of the Head of the Inspection.

10. The Control Inspection at the Ministry of Health of the Republic of Uzbekistan works along with the annual programs, being endorsed by the Minister of Health of the Republic of Uzbekistan.

11. Rating of the Control Inspection staff is being done not less than once in 2 years. The procedure of rating of Control Inspection staff is defined by the Minister of Health of the Republic of Uzbekistan.

VI. RESPONSIBILITY OF THE CONTROL INSPECTION STAFF

12. Control Inspection staff members are responsible for misuse of authority in the order established by current legislation.
